Terms and Conditions

These Terms and Conditions govern the use of the Hello Homeo SaaS platform by clinic subscribers, clinic users, and patients.

By registering as a subscriber, using the platform, or booking an appointment through a Hello Homeo-powered clinic, you agree to these terms. This includes consent to receive WhatsApp communications as described in Section 8.

1. Platform Overview & Definitions

Hello Homeo ("we", "us", "the Platform") is a Software-as-a-Service (SaaS) clinic management solution that enables homeopathic clinics and healthcare practices to manage appointments, patient records, prescriptions, billing, pharmacy, laboratory workflows, and teleconsultation.

Key definitions:

• "Subscriber" or "Clinic" — a healthcare practice or organisation that subscribes to Hello Homeo to manage its operations.

• "Clinic User" — doctors, pharmacists, lab technicians, and administrators authorised by a Subscriber to use the platform.

• "Patient" — an end user who books an appointment or receives services through a Subscriber's clinic portal.

• "Services" — all features, tools, and capabilities made available through the Hello Homeo platform.

By accessing or using Hello Homeo — whether as a Subscriber, Clinic User, or Patient — you agree to these Terms and Conditions in full.

2. Subscriber Accounts & Access

• Each Subscriber is issued a unique clinic account and subdomain (e.g., /c/your-clinic/) within the platform.

• The Subscriber is responsible for all activity that occurs under their account, including the actions of Clinic Users they invite.

• Clinic Users must not share login credentials. Each user must access the platform only through their own account.

• Subscribers are responsible for maintaining the confidentiality of their account credentials and must notify us immediately of any unauthorised access.

• Hello Homeo reserves the right to suspend or terminate accounts that violate these Terms.

3. Subscription Plans & Billing

• Hello Homeo offers tiered subscription plans (Basic, Startup, Clinic, Clinic Pro, Enterprise) with different feature sets and usage limits.

• New subscribers may be eligible for a free trial period as shown at the time of registration.

• Paid subscriptions are billed in advance for the chosen plan period. Payments are processed securely via Razorpay.

• Plan upgrades take effect immediately upon payment. Downgrades and cancellations take effect at the end of the current billing period.

• Add-on bundle credits (teleconsultation minutes, WhatsApp messages, AI credits) are purchased separately and are non-refundable once consumed.

• Hello Homeo reserves the right to modify plan pricing with reasonable prior notice to Subscribers.

4. Acceptable Use Policy

Subscribers and Clinic Users agree not to:

• Use the platform for any unlawful purpose or in violation of applicable Indian laws and healthcare regulations.

• Attempt to gain unauthorised access to other clinics' data, systems, or accounts.

• Reverse-engineer, decompile, or copy any part of the platform's software or intellectual property.

• Upload or transmit malicious code, viruses, or disruptive content.

• Use Hello Homeo to process data in ways that violate patient privacy rights or applicable data protection laws.

Hello Homeo reserves the right to suspend or terminate accounts in cases of misuse, abuse, or violation of these terms without prior notice.

5. Healthcare Services & Patient Data

Hello Homeo is a technology platform — it is not a healthcare provider. Medical consultations, diagnoses, prescriptions, and clinical decisions are the sole responsibility of the Subscriber's qualified medical practitioners.

Data responsibility:

• Subscribers (clinics) are the data controllers for their patients' personal and medical data.

• Hello Homeo acts as a data processor — handling patient data only as instructed by the Subscriber to operate the platform.

• Subscribers are responsible for obtaining appropriate patient consent before collecting or processing their personal data through the platform.

• Hello Homeo implements reasonable technical and organisational security measures to protect data held on the platform.

• Patient data is not shared across clinics. Each Subscriber's data is strictly isolated within their own tenant.

6. Teleconsultation

• Hello Homeo provides a video consultation feature powered by Stream Video & Audio (getstream.io).

• Video calls are encrypted and conducted between authorised clinic users and patients.

• Patients are responsible for a stable internet connection. Technical issues on the patient's end do not constitute a platform failure.

• Teleconsultation is not suitable for medical emergencies. Patients experiencing emergencies must seek immediate in-person care.

• Clinical decisions made during teleconsultation are the responsibility of the consulting doctor, not Hello Homeo.

7. Patient-Facing Appointment Booking

• Patients who book appointments through a clinic's Hello Homeo-powered portal are subject to that clinic's own policies for fees, scheduling, and medical care.

• Hello Homeo facilitates the booking and communication process but is not a party to the clinical relationship between patient and clinic.

• Website and blog content published through the platform is for informational purposes only and does not substitute direct medical consultation.

• Unauthorised use, copying, or misuse of platform content is prohibited.

8. WhatsApp Communications

Clinics using Hello Homeo may enable WhatsApp-based appointment notifications for their patients via the Meta WhatsApp Business Cloud API. By providing your WhatsApp-registered mobile number to a clinic and booking an appointment, you expressly consent to receive WhatsApp messages from that clinic. These messages may include:

• Appointment confirmations, reminders (24 hours and 1 hour prior), and rescheduling notices

• Prescription readiness and dispensing notifications

• Follow-up reminders and general healthcare communications

• Responses to messages you initiate with the clinic's WhatsApp chatbot

Opt-Out: You may stop receiving WhatsApp messages at any time by sending the word STOP to the clinic's WhatsApp business number. You can restart notifications by sending START.

Message Frequency: Message frequency varies based on your appointments and interactions. Standard messaging rates from your mobile carrier may apply.

Third-Party Platform: WhatsApp messages are delivered through Meta Platforms, Inc. WhatsApp Business Cloud API. By opting in, you acknowledge that your phone number and message content are processed by Meta in accordance with Meta's Privacy Policy (https://www.facebook.com/privacy/policy/).

Consent to WhatsApp communications is not a condition of receiving medical services from any clinic.

9. Intellectual Property

• Hello Homeo and all its software, design, algorithms, and content are the intellectual property of Hello Homeo and its licensors.

• Subscribers retain ownership of all data they and their patients input into the platform.

• Upon account termination, Subscribers may request an export of their data. Data will be retained for 30 days post-termination before permanent deletion.

• No part of the Hello Homeo platform may be reproduced, distributed, or used to build competing products without prior written consent.

10. Limitation of Liability

Hello Homeo is a software platform and is not liable for:

• Clinical decisions, medical outcomes, or errors in patient care made by Subscribers or their staff.

• Data loss resulting from Subscriber misuse or failure to follow recommended security practices.

• Service interruptions caused by third-party providers (internet connectivity, Supabase, Razorpay, Stream, Twilio, Meta/WhatsApp) or force majeure events.

• Consequential, indirect, or incidental damages arising from use or inability to use the platform.

Hello Homeo's total liability to any Subscriber shall not exceed the total subscription fees paid by that Subscriber in the preceding 12 months.

11. Modifications

Hello Homeo may update these Terms & Conditions at any time. Subscribers will be notified of material changes. Continued use of the platform after changes take effect implies acceptance of the revised terms.
